The NAB believes that the Authority’s role in co-ordinating the SAMF must comply with its statutory obligations, aims and objectives as set out in the Independent Broadcasting Authority Act, 153 of 1993 (“the IBA Act”), the Broadcasting Act 4 of 1999 (“the Broadcasting Act”) and the Telecommunications Authority Act 103 of 1996 (“the Telecommunications Act”).
The NAB acknowledges that the Authority’s objectives include inter alia, promoting a diverse range of broadcasting services that takes into account South Africa’s various cultures, languages and religions.
However to interpret the Authority’s objectives so widely so as to extend the Authority’s objectives to include monitoring industries other than the broadcasting industry would be contrary to the intention of the legislature.
